After buying an old domain I just found that there are few footer links which lead to the porn sites. Should my site be penalized for this? There are MAP's in the webmasters tool.

I don't understand if they are outgoing links then why don't you just remove them?!!

you can remove the links from the footer it is just outgoing link.
